A health care provider may not be required to document a barrier to an in-person visit to provide health care services through telehealth. The department or a board may not limit the physical setting from which a health care provider may provide health care services through telehealth.

Telemedicine Business Registry

Section 12 AAC 02.600 repealed and replaced by 12 AAC 12.025 and 035.

A business that performs telemedicine services shall register with the telemedicine business registry before providing telemedicine services to a recipient located in this state. The business shall register with the business name the business will use to perform telemedicine services in this state.

A business that operates under multiple business names to perform telemedicine services must file a separate registration for each business name before that business provides telemedicine services to a recipient located in this state.

One telemedicine registration for each business name is sufficient to cover all health care services the business provides.

To be registered on the telemedicine business registry, a business that performs telemedicine services shall pay the applicable fee as established in AS 44.33.381 and

  • apply for registration as part of the initial application for a new business license under 12 AAC 12.030 or the application for renewal of a business license under 12 AAC 12.040, and complete the telemedicine business registration section of the application; or
  • submit a telemedicine business registration form to the department, if the applicant is the holder of an existing business license not previously registered to provide telemedicine services.

A telemedicine business registration is subject to renewal every two years, together with the corresponding business license, and expires on the same expiration date. To renew a telemedicine business registration, the business shall

  • submit a business license renewal application in accordance with 12 AAC 12.040;
  • elect to maintain the telemedicine business registration; and
  • pay the applicable fee as established in AS 44.33.381.

If a business terminates the performance of telemedicine services, the business shall notify the department and request that the department remove the business from the telemedicine business registry.

The department will renew a business license that has been lapsed for two years or less if the applicant for renewal of the business license pays the business license renewal fee specified in 12 AAC 12.010(b) in a manner specified by the department on the renewal application. The renewal application must include the name, title, and signature or electronic signature of the natural person completing the application as an authorized representative of the business.

The department will renew a telemedicine business registration as part of a business license renewal application submitted by a business that continues to provide telemedicine services.

A person who is licensed or registered under AS 08.11 may provide telemedicine services to a client in the state if:

  • The telemedicine services are of the same scope, nature, and quality as those services provided in person;
  • The quality of electronic transmissions used to provide telemedicine services allow the licensee or registrant to provide services equivalent to those provided in person;
  • The licensee or registrant has the skill and ability to operate the equipment used to provide telemedicine services;
  • The licensee or registrant assesses the client’s level of comfort in receiving telemedicine services and makes appropriate adjustments to the treatment plan based on that assessment;
  • The licensee or registrant ensures the presence of a telemedicine facilitator who is physically present with the client when appropriate;
  • The licensee or registrant ensures that the client can contact a licensed health care provider in person as part of the client’s treatment plan;
  • The licensee or registrant ensures that the electronic transmissions used to provide telemedicine services have sufficient security to ensure the protection of the client’s medical records as if the client were receiving in-person treatment; and
  • The licensee or registrant does not provide telemedicine services solely through written correspondence; however, written correspondence may be used to supplement telemedicine services.

Nothing in this section prevents the use of asynchronous telemedicine.

  • through telehealth under AS 08.02.130 while the health care provider was located at a clinic, facility, or site listed in (A) of this paragraph or the private office of the health care provider and the health care provider was acting within the scope of the provider’s responsibilities at the clinic, facility, or site listed in (A) of this paragraph;
